2. SMS / Text Message Communications

The information (phone numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.

1. Acceptance of Terms
By providing your contact information, enrolling in programs, or communicating with D2D, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy.
2. SMS Program Terms
Consent & Enrollment
By providing your phone number and opting into SMS communications, you expressly consent to receive automated and non-automated text messages from D2D at the phone number provided.
Consent is not a condition of program participation (D2D programs are provided at no cost to participants).
You certify that you are the subscriber or authorized user of the phone number provided, or that you have obtained consent from the subscriber.

6. Limitation of Liability
To the fullest extent permitted by law:
D2D provides educational programming on an "as is" basis without warranties of any kind
D2D is not liable for any indirect, incidental, consequential, or special damages arising from program participation or SMS communications
D2D's total liability shall not exceed the fees paid for services (if any; programs are typically free)
This includes but is not limited to damages from errors, omissions, interruptions, or delays in service

7. Indemnification
You agree to indemnify and hold harmless D2D, its directors, officers, employees, volunteers, and partners from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from:
Your violation of these Terms of Use
Your misuse of D2D services or communications
Your violation of any third-party rights

8. Privacy & Data Protection
Your use of D2D services is governed by our Privacy, Communications, and SMS Policy (see above), which is incorporated into these Terms by reference.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Maryland, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Maryland. Both parties agree to submit to the personal jurisdiction of such courts.
10. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
11. Entire Agreement
These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and D2D regarding your use of our services and supersede all prior agreements and understandings.
12. Changes to Terms
D2D may update these Terms periodically to reflect changes in our practices, technology, or legal requirements. Material changes will be communicated via email or SMS when possible.
